According to official letter No.1287/LĐTBXH-LĐTL:

In case, employers hire employees to work overtime in annual leaves and stated by employers, employees paid salary at least 300% of the actual salary not including salary of day-leaves enjoying salary for day-salary employees.

In case, employees resign, lose jobs due to other cause but not yet off annually or not yet off all annual leaves as regulations of clause 4 article 26 Decree 05/2015/NĐ-CP (100% salary as contract).

The company stipulates annual leaves corresponding to the job trial time. After job trial time, if signing labor contracts, it is included annual leaves, if not, the payments of leaves will be applied. This is not violates Law.
